These Terms of Service ("Terms") govern your use of the AdvoKate platform and services. By using AdvoKate, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using AdvoKate, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Service

AdvoKate is a health management platform that provides:

  • AI-powered health tracking and conversations (Kate)
  • Care Circle coordination with family and friends
  • Downloadable health reports for sharing with healthcare providers
  • Wearable device integration
  • Health trend analysis and reporting

3. Important Medical Disclaimer

AdvoKate is a wellness tool, not a medical device. It does not provide medical advice, diagnosis, or treatment. Always consult qualified healthcare providers for medical decisions. In emergencies, call 911 or go to the nearest emergency room.

4. Account Requirements

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You may not share your account credentials

5. SMS/Text Message Terms

5.1 ADVO/Kate Health Notifications Program

By providing your phone number and enabling SMS notifications, you consent to receive text messages from ADVO/Kate Health Notifications. This program includes:

  • Security verification codes (two-factor authentication)
  • Medication reminders
  • Appointment reminders
  • Health check-in prompts
  • Care Circle activity alerts

You can enable or disable each notification category individually in your account settings.

5.2 SMS HIPAA Compliance

Privacy Protection: To protect your health information, all AdvoKate SMS messages are HIPAA-compliant and contain no Protected Health Information (PHI). Messages are generic notifications that direct you to the app for details.

Sample messages:

  • "ADVO/Kate: Time for your medication. Open the app to view details."
  • "ADVO/Kate: You have an upcoming appointment. Check the app for information."
  • "ADVO/Kate: Time for your daily health check-in. Tap to log your vitals."
  • "ADVO/Kate: New activity in your Care Circle. Open the app to view."
  • "ADVO/Kate: Your verification code is: [CODE]. Valid for 10 minutes."

5.3 Message Frequency and Rates

Message frequency depends on your notification settings and activity:

  • Security codes: Sent only when you log in or perform sensitive account actions
  • Medication reminders: Based on your medication schedule (may be up to 10 messages per day for complex regimens)
  • Appointment reminders: 1-2 messages per appointment (typically 24 hours and 2 hours before)
  • Health check-ins: Based on your configured schedule (typically 1-3 per day)
  • Care Circle alerts: As activity occurs (you control which events trigger alerts)

Message and data rates may apply. Contact your carrier for details about your text messaging plan.

5.4 Opting Out of SMS

You may opt out of SMS notifications at any time:

  • Per-category: Go to Account → Notifications in the app to disable specific notification types
  • All messages: Reply STOP to any AdvoKate message to unsubscribe from all non-security SMS
  • Get help: Reply HELP to any message for assistance

Note: If you use SMS for two-factor authentication, security codes cannot be disabled. You may switch to an authenticator app in your security settings to stop receiving security SMS.

6. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Share false or misleading health information
  • Attempt to access other users' accounts or data
  • Interfere with the platform's operation
  • Use automated systems to access the service without permission

7. Care Circle

When you invite others to your Care Circle:

  • You control what information they can access
  • You are responsible for ensuring invitees have legitimate purposes
  • You can revoke access at any time

8. Subscription and Payment

  • Free tier features are available at no cost
  • Premium features require a paid subscription
  • Subscriptions renew automatically unless cancelled
  • Refunds are provided per our refund policy
  • We may change pricing with 30 days notice

9. Data Ownership

You retain ownership of your health data. You grant AdvoKate a license to use your data solely to provide and improve our services. See our Privacy Policy for details.

10. Intellectual Property

The AdvoKate platform, including Kate AI, is protected by intellectual property laws. You may not copy, modify, or distribute our software without permission.

11. Disclaimer of Warranties

AdvoKate is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, AdvoKate's liability is limited to the amount you paid for the service in the 12 months preceding any claim.

13. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, you may export your data per our data portability policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the platform. Continued use constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions.
